The Company is the owner, author and publisher of the internet resource https://medmitr.com and the mobile application ‘Medmitr’ (collectively, the “Website”). The Company owns and operates the services provided through the Website.

The following are terms of a legal agreement between You and JJ Wellness Network Private Limited

By downloading, accessing, browsing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations.

Before you continue, you are required to read through the Terms of Use and Privacy Policy, as it forms a binding agreement between you and The Company regarding your visit to the Website and regarding your use of our services.

You agree that any registration information you give to The Company will always be accurate, correct and up to date.

Location Information

We access precise location data of your mobile device when the Website is running in the foreground. This is to show you the list of The Company’s healthcare service providers listings near you and to identify if you are in the proximity of one of our providers. Our provider listings are made available via Google maps API.

The Website may use “cookies” to enhance your experience. Your web browser places cookies on a hard drive for record-keeping purposes and sometimes to track information about them. You may choose to set the web browser to refuse cookies or to alert you when cookies are being sent. If they do so, note that some parts of the Website may not function properly.

• To collect feedback of Website's, healthcare service provider
  The Company will provide rating scale of 5 stars on the Website, which will enable you to review and rate the service, procedures, treatments that you avail from our healthcare service provider.
• To improve the Website
  We may use feedback you provide to improve our products and services.
• To send periodic emails
  We may use the email address to send you information and updates pertaining to our new healthcare service providers, their services and offers. It may also be used to respond to your queries, questions, and/or other requests.

How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and medical data stored on the Website.

Changes to this privacy policy

The Company has the discretion to update this privacy policy at any time. When we do, we will post a notification on the Website. We encourage you to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Payment service

In order to make payment for availing services through the Website; you might need to provide Bank account number, Credit/Debit Card number, Card Expiry Date, Name on Card. All the information is securely stored within our provider systems as per the Company’s DSS standards. Also, encryption mechanisms are used to protect the transmission of this data to our provider’s backend servers.

Transaction Information

We may collect transaction information which may include – Date, time, transaction amount, the Company’s healthcare service provider name, payment method, payment instrument, location, email and phone number of user and healthcare service provider’s, offers associated with transaction and description of the transaction.

Updates

The Website which you use may require you to install updates from time to time. These updates are designed to improve, enhance and further develop the Website and may take the form of bug fixes, enhanced functions, new features and or completely new versions. You agree to receive such updates as part of your use of the Website.

Ownership

• All materials, including all copyrights, trademarks, logos and other identifying marks shall remain the exclusive property of the Company. The contents of the Website shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way for any purpose.
• Modification of any of the Contents or use of the Contents for any other purpose will be a violation of the Company's copyright and other intellectual property rights. Graphics, design and images on the Website are protected by copyright and may not be duplicated, reproduced or appropriated in any manner.

Limitation of Liability

You expressly understand and agree that your use of the Website is at your sole risk and that the services are provided "as is" and "as available".

In particular, the Company, its medical service providers and affiliates do not represent or warrant to you that:

• Your use of the services will meet your requirements or failure to provide all or any service by our healthcare service provider.
• Your use of the services will be uninterrupted, timely, secure or free from error
• Any information obtained by you as a result of your use of the Website will be accurate or reliable; and
• That defects in the operation or functionality of the Website provided to you as part of the services will be corrected.

The Company shall also not be liable for any damage or loss of any kind caused as a result (direct or indirect) of the use of the Website, including but not limited to any damage or loss suffered as a result of reliance on the contents contained in or available from the Website.

Refund and Returns

If you are not completely satisfied, you may call 022 - 27810151 to cancel at any time. If you cancel within the first 30 days, your membership fee will be refunded. The onetime member activation fee is non-refundable. After you have called to cancel, you will need to provide a written letter verifying that you cancelled the plan, the letter should also include your unique member identification number, an original signature and you have to return to us all the materials and collaterals (if any) that you have received along with the medical discount program. You can send this letter via India post or courier to Cancellation department, Chiranjiv Tower, 43, Nehru Place, New Delhi - 110019. Call to verify that your cancelation letter has been received. Upon receipt of written cancellation, your membership to the medical discount program will be terminated and your refund will be processed.

Medmitr Digital health card (Applicant ID card)

Register for an Applicant ID card on the Medmitr application.

Input your latest Photo (face to be clear), provide your personal information, including name, address, email, phone no. On completing the registration form, your Applicant ID card along with a unique member identification number is activated and shall appear within the app. The registration process is the same for your co-applicant as well.

After activation, the Applicant ID card can be used over and again.

Your Applicant ID should be produced by you at all times to provide proof of the right to avail services under this Agreement.

Terms of Use of Applicant ID Card:

• The Website shall show all the Company healthcare service provider near you. Choose a provider of your choice to avail the desired medical care.
• You will pay the discounted rate at the time of purchase, billing or while availing a service by showing your Applicant ID card.
• Please ensure that your Applicant ID card is always shown before the bill is processed.
• The Applicant ID card only facilitates the users to get discount on medical expenses of any type incurred within the Company healthcare service provider network.
• You are obligated to pay for all healthcare services at the time the services are performed; but will receive a discount from the Company contracted providers.
• In case if the user is referred by a Doctor for obtaining an opinion or treatment from any of the Company’s healthcare service provider, it is the sole discretion of the Company’s healthcare service provider, to extend the discount to the user. Bases the good medical practice – the Company shall not be liable to extend any compensation to the user if the Company’s healthcare service provider does not extend the discount to the user in case of “Doctor Referral”
• The discounts contained herein cannot be used in conjunction with any other offer, medical discount program or Plan.
• Discounts will be extended only to the applicant or co-applicant and or if only the applicant or co-applicant is making the payment towards the medical services availed. Discount will not be applicable if the payment towards the medical services availed is made by a third-party administrator (TPA) or an Insurance company.
• Discounts are not applicable on blood charges and on services mentioned within the offer.
• The Company shall use its best efforts to obtain acceptance from an adequate number of providers who will agree to provide services. The final selection of the medical professional and/or medical facility and the approval or disapproval of medical treatment is your choice alone.
• Service providers contracted by the Company are solely responsible for the professional advice and treatment rendered to you and the Company disclaims any liability with respect to such matters.
• The Company will not interfere with the treatment and medical care provided to you. The Company will not be in any way held responsible for the outcome of treatment or quality of care provided by the healthcare provider.
• Any liability arising due to any default or negligence in providing of medical services shall be borne exclusively by the healthcare provider who shall alone be responsible for the defect and or deficiencies in rendering such services.
• The healthcare provider shall be responsible in any manner whatsoever for the claims, arising from any deficiency in the services or any failure to provide identified service or for any acts, omission or commission of the Doctors and another medical staff.
• The healthcare provider shall alone be liable to pay any costs for retesting, damages and or compensation demanded by the beneficiary for poor, wrong, medical negligence, bad quality or of the test report or treatment given to you by the healthcare provider.
• The Company healthcare service providers are subject to change without notice and the Company shall substitute a provider into the Company network at its sole discretion. The Company cannot guarantee the continued participation of any provider.
• In case of any dispute or difference in respect of or in connection with the offers herein, the decision of the Company shall be final and binding on all concerned.

Effective Date and Renewal: Your effective date is indicated on your applicant ID card and is subject to renewal for a similar period upon your consent.

Right of Access

The Company reserves all rights to deny or restrict access to the Website to any particular user, at any time, without ascribing any reasons whatsoever.

Governing Law

You agree that this agreement and any contractual obligation between the Company and you shall be governed and construed in accordance with the laws of India and the exclusive jurisdiction of the courts in New Delhi.

Disclosures:

This medical discount program is not an Insurance Policy. This program entitles the member to receive the discount for medical services from healthcare service providers who have contact with the Company. The members shall pay the net amount for the medical services availed after deducting the applicable discount.
